Leaders In Utah Chapter 7 & Chapter 13 Bankruptcy
Bankruptcy laws can be overwhelming if you’re not experienced in the process. Save time and hassle with an Utah bankruptcy attorney who can help you file for the right type of bankruptcy. Start your filing today and get relief from the constant weight of medical expenses, unpaid credit cards, personal loans, or other unsecured debts.
What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is often referred to as liquidation bankruptcy because your assets as an individual or business owner are used to repay creditors. Once that process is complete, there is no repayment plan, and the remaining debt is discharged.
Certain debts cannot be discharged in Chapter 7 bankruptcy, including alimony, child support, court fees, and student loans. Not everyone qualifies for Chapter 7, so inquire about your eligibility by contacting us today.
What is Chapter 13 Bankruptcy?
In Chapter 13 bankruptcy, you can keep your assets while setting up a repayment plan that pays a portion of the debt for three to five years. After the specified time, your debt is discharged. Consider it a reorganization of debt that does not require liquidation of assets. Chapter 13 is not usually for small business bankruptcy, but is instead intended for individuals with overwhelming debt.
Chapter 13 bankruptcy stays on a credit report for 10 years, and can apply to student loan and tax debts. However, there is a total debt limit.
